The Article 84 formula
Half a month's wage per year for years one through five, one full month's wage per year from year six onward, calculated on your final wage and pro-rated for partial years. There is no cap — long service keeps accruing.
Resignation changes the math (Article 85)
If you resign: under 2 years of service you receive nothing, 2 to 5 years earns one-third of the award, 5 to 10 years earns two-thirds, and after 10 years you receive it in full. Termination by the employer or contract expiry pays the full amount at any length of service.
Check before you sign
The wage base includes your basic salary plus fixed allowances per your contract; disputes go through the Ministry of Human Resources (HRSD). Run the number here first so you walk into the settlement conversation knowing what the law says.
